Rear-end crashes are the most common type of car accident in the U.S., according to the National Safety Council. It estimates that Americans are involved in more than 2.5 million rear-end collisions every year. Trailing drivers are usually – but not always – at fault for these crashes because of their negligent or reckless driving behaviors, such as:

  • Tailgating

Of the preceding, tailgating is the most significant contributor to rear-end accidents. That’s why Texas law requires that drivers “maintain an assured clear distance between the two vehicles so that, considering the speed of the vehicles, traffic, and the conditions of the highway, the operator can safely stop without colliding with the preceding vehicle or veering into another vehicle, object, or person on or near the highway.” (Texas Vehicle Code Sec. 545.062). Quite simply, if a driver doesn’t leave enough room between his or her car and the next car in front, a rear-end accident is more likely to happen, no matter how hard the rear driver may slap on the brakes.

While, as noted, trailing drivers are most often at fault in rear-end accidents, the leading car can cause or contribute to a crash due to:
